Terms of Service

1. Acceptance of Terms

By accessing or using PT Documentation AI ("Service") operated by Pluto Biz Solutions ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

PT Documentation AI is an AI-powered clinical documentation platform that assists physical therapists and other licensed healthcare professionals in generating SOAP notes from voice recordings and structured clinical context. The Service is intended as a documentation aid only and does not constitute medical advice, clinical decision support, or a substitute for professional clinical judgment.

3. Eligibility and Account Registration

You must be a licensed healthcare professional or authorized staff member working under the supervision of a licensed professional to use this Service. You must be at least 18 years of age. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Subscription and Payment

Access to the Service requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law or as described in our refund policy. We reserve the right to change subscription pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to generate fraudulent clinical documentation
• Submit recordings of individuals without their knowledge or consent
• Attempt to reverse-engineer, decompile, or extract the AI models or algorithms
• Use the Service in any way that violates HIPAA or other applicable healthcare regulations
• Share your account credentials with unauthorized individuals
• Use automated scripts or bots to access the Service

6. Clinical Responsibility

The AI-generated SOAP notes are a documentation aid, not a final clinical record. You are solely responsible for reviewing, editing, and approving all documentation before it is submitted to any EMR, payer, or regulatory body. The Company is not responsible for clinical errors, omissions, or inaccuracies in AI-generated content. You must apply your professional judgment to all generated documentation.

7. HIPAA and Data Privacy

If you are a HIPAA covered entity or business associate, you must execute a Business Associate Agreement (BAA) with us before entering any Protected Health Information (PHI) into the Service. Use of the Service without a signed BAA when required by HIPAA is a violation of these Terms and may expose you to regulatory liability.

8. Intellectual Property

The Service, including its software, design, and AI models, is owned by Pluto Biz Solutions and protected by intellectual property laws. You retain ownership of the clinical documentation you create using the Service. You grant us a limited license to process your content solely to provide the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLUTO BIZ SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO CLINICAL ERRORS, REGULATORY PENALTIES, OR LOSS OF DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE THREE MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may cancel your subscription at any time through the Billing page. Upon termination, your access to the Service will cease and your data will be retained for 90 days before permanent deletion, unless you request earlier deletion.

12. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Texas.
